The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Applications refers to our suite of AI-powered mobile applications: Propify AI (betting analysis), Fitiva AI (workout and food scanner for women), and Micro AI (micronutrient tracker), provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Propify App LLC.
• Country refers to the United States.
• Device means any device that can access the Services such as a computer, a cellphone or a digital tablet.
• Services refers to all Applications provided by the Company.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Services.
• You means the individual accessing or using the Services.

These are the Terms and Conditions governing the use of our Services and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Services.

You represent that you are over the appropriate age for each service. For Propify AI, you must be 18 or older. For Fitiva AI and Micro AI, you must be 13 or older.

User Accounts

When You create an account with Us, You must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under Your account.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

Prohibited Uses

You may not use our Services:

• For any unlawful purpose or to solicit others to do unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances

Content and Intellectual Property

The Services and their original content, features and functionality are and will remain the exclusive property of Propify App LLC and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without Our prior written consent.

App-Specific Terms and Disclaimers

Propify AI - Betting Analysis

Our AI-powered betting analysis and recommendations are provided for informational and educational purposes only. Important disclaimers:

• No analysis or recommendation guarantees winning outcomes
• Past performance does not indicate future results
• All betting and gambling decisions are made at your own risk
• Our AI models are based on statistical analysis and may not account for all variables
• You should conduct your own research before making any betting decisions
• We are not responsible for any losses incurred from following our recommendations
• You must be 18 or older to use Propify AI

Fitiva AI - Workout and Food Scanner

Fitiva AI provides personalized workout plans and food scanning technology. Important considerations:

• Workout recommendations are generated by AI and may not be suitable for all fitness levels
• Consult with a healthcare provider before starting any new exercise program
• Food scanning results are estimates and may not be 100% accurate
• We are not responsible for injuries or health issues resulting from following workout recommendations
• This app is designed with women's fitness goals in mind but can be used by anyone

Micro AI - Micronutrient Tracker

Micro AI helps track micronutrients and provides supplement recommendations. Important disclaimers:

• Nutritional tracking and supplement recommendations are for informational purposes only
• This app is not a substitute for professional medical or nutritional advice
• Consult with a healthcare provider or registered dietitian before making significant dietary changes
• Supplement recommendations should be verified with a healthcare professional

• Individual nutritional needs vary and may not be accurately captured by our AI models

Age Restrictions and Legal Compliance

You must meet the minimum age requirements for each service. By using the Services, you represent and warrant that:

• You are of legal age in your jurisdiction for the specific service you're using
• For Propify AI: You are 18 or older and legally allowed to participate in betting activities in your location
• For Fitiva AI and Micro AI: You are 13 or older
• You will comply with all applicable local, state, and federal laws
• You understand the risks associated with each service

Subscription and Payment Terms

Some parts of the Services are billed on a subscription basis. You will be billed in advance on a recurring basis. Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan You select.

At the end of each billing cycle, Your subscription will automatically renew unless You cancel it or We cancel it. You may cancel Your subscription renewal through Your account settings or by contacting customer support.

Refunds

Except when required by law, paid subscription fees are non-refundable. Certain refund requests for subscriptions may be considered by the Company on a case-by-case basis and granted at its sole discretion.

Termination

We may terminate or suspend Your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach the Terms.

Upon termination, Your right to use the Services will cease immediately. If You wish to terminate Your account, You may simply discontinue using the Services.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Services.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including without limitation, damages for loss of profits, loss of data, business interruption, personal injury, or any other damages arising out of or in connection with the use or inability to use the Services.

"AS IS" and "AS AVAILABLE" Disclaimer

The Services are provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Services.

Health and Safety Considerations

For health and fitness related services (Fitiva AI and Micro AI):

• Always consult with healthcare professionals before making significant changes to your exercise or nutrition routine
• Stop exercising immediately if you feel pain, dizziness, or discomfort
• Our AI recommendations are general and may not account for your specific health conditions
• If you have any medical conditions, allergies, or dietary restrictions, consult with a healthcare provider
• Pregnant or nursing women should consult with their healthcare provider before using our services

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
